Most of our clients are first-time defendants facing the criminal justice system for the first time. If you are charged in the 86th District Court or looking at a felony case that may move into the 13th Circuit Court, one of the first things you may wonder is whether everyone just ends up taking a plea deal. That is a very common fear, especially for people who have never been through this process before.

When people hear that we are trial-ready or trial-forward, they sometimes picture something aggressive or dramatic. That is not how we see it. In our practice, trial preparation is about protection. It is about getting beneath the surface of the charge, understanding what the evidence really shows, and making sure important decisions are made from a position of preparation rather than fear.

For many people, the preliminary examination is the first point in the case where the process starts to feel serious in a different way. Arraignment can feel fast. Bond conditions can feel disruptive. But the prelim often feels like the first day when evidence is actually discussed in a courtroom. That can make the hearing seem bigger than it is. The important thing to understand is that a preliminary examination is not a jury trial, and it is not a final decision about guilt or innocence. It is a limited evidentiary hearing in the 86th District Court focused on one question: whether there is probable cause to continue the felony case and send it to the 13th Circuit Court.

The 2025 report is, in our view, one of the clearest pieces of evidence for why a trial-forward posture matters, and why a first-time defendant should ask hard questions about whether their lawyer is actually built to try a case.

For many first-time defendants, the phrase jury trial sounds larger and harsher than the experience they have had up to that point. It can feel like the point where everything becomes public, formal, and final. In reality, a jury trial is a structured legal process with a specific purpose: to determine whether the prosecution has proven a charge beyond a reasonable doubt. It is not theater, and it is not something you are expected to understand instinctively on your own.

One of the most common misunderstandings in a criminal case is the idea that the police report is the case. For many first-time defendants, the report feels final. It is typed up, it sounds official, and it often reads with confidence. If you have never been charged before, it is easy to assume that whatever is written there will control everything that follows.

Bond and probation violation hearings can feel especially frightening because they often come with a different kind of pressure than the original case. In many criminal cases, a first-time defendant still feels like there is time to get oriented. In a bond or probation violation setting, that feeling is often gone. People worry they could be taken into custody at the hearing, lose their footing at work or home, and suddenly find themselves dealing with jail in addition to the underlying case.

A resisting and obstructing charge can be especially confusing because many people hear the label and immediately assume it means something more dramatic than what they remember happening.

A lot of people charged with a lower-level offense in the 86th District Court make the same mistake at the beginning: they assume the charge is too small to matter. That is usually not the safest way to look at it. The case may sound small on paper, but it does not feel small once you are the person standing in court.
